Amanda Cares, Inc. dba Amanda the Panda (Amanda the Panda) has adopted the following privacy policy for the Website (the “site”). This policy describes how we use and safeguard information collected through the site and the choices you can make regarding your personal information. In this policy, the terms “we” and “our” mean Amanda the Panda and “you” and “your” means each visitor to the site.

Information We Collect

Personally identifiable information (“Personal Information”) we may collect through the site includes your name, e-mail address, postal address, telephone number, credit card and other billing information, donation history, the names and addresses of anyone to whom you identify to us and any other information you voluntarily disclose.

We collect Personal Information in the following ways:

  • When you sign up for our mailing list, we will ask for your name, e-mail address and postal address.
  • When you make a donation, we will ask for your name, e-mail address, billing and shipping address, telephone number and payment information.
  • When you post comments on a blog, our FACEBOOK®* page, or any other social media or networking site, you may voluntarily share information about yourself.
  • We also collect non-personally identifiable information automatically from all visitors to the site. Such information includes the number of visitors to the site, how visitors locate the site, the pages each visitor views, the name of each visitor’s Internet service provider, the Internet address (“IP Address”) assigned to each visitor’s computer, information about a visitor’s Internet browser and information about searchers performed on the site. We use this non-personally identifiable information to monitor how the site is used and to improve site performance.

How We Use Your Personal Information

The Personal Information we collect is used to send communications to you, such as our appeal letters, our annual reports, our newsletters, and thank you notes. If you submit a donation to Amanda the Panda, we record your donation in association with your Personal Information in our database.

Information Sharing

We may share your personal information with others in the following circumstances:

  • We may use third-party service providers to process payments/donations and to pack and deliver Cheer Boxes to you. We will share your information with these service providers to the extent needed for them to perform their services. We require service providers to protect your personal information.
  • We may use information posted in public areas of the site (such as comments or testimonials) for our business purposes, including in marketing and advertising materials. We will not use such information in a way that identifies the person who posted it, unless we receive prior express consent from you.
  • We will disclose Personal Information when necessary to comply with law, regulation or other legal process, to enforce our rights, or to protect the rights, property or safety of others.
  • If Amanda the Panda or substantially all of our assets are acquired as a result of an acquisition, merger, sale, reorganization or liquidation, Personal Information may be one of the transferred assets.

Except as described above, we will not share your personal information with anyone without your consent.

Information in Public Areas is Public

If you post messages on our blog, on our FACEBOOK® page, or on another social networking site, that information will be visible to other users. Any information you submit through one of these forums can be read, collected and used by other visitors to the site. We are not responsible for the security of information you choose to post in these public areas or for how any third party may use that information.

Updating Your Information

If any of the Personal Information you submitted to our site is inaccurate or outdated or otherwise needs to be changed, please contact us at and we will use reasonable efforts in our control to revise that information.

You may ask to have the Personal Information in your account deleted or removed; however, because we keep records of past transactions, we cannot delete information associated with past transactions on this site. In addition, it may be impossible to completely delete your personally-identifiable information without some residual information remaining because of backups.

In addition to our technical safeguards, access to your Personal Information is allowed only to staff that require such access and we require our staff to keep that information in confidence and to keep it secure. Children’s Guidelines

Protecting the privacy of children is very important to us. For that reason, our site does not intentionally solicit, collect and/or maintain personally-identifiable information from users under age 13. If you are under the age of 13, we ask that you do not submit any Personal Information to us and use this site only under the supervision of a parent or guardian. Applicable Law

This policy shall be governed by, and construed and enforced in accordance with, the laws of the State of Iowa, without giving effect to any principles of conflicts of laws. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to this policy or your use of this site shall be filed only in the state or federal courts located in Des Moines, Iowa, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purposes of litigating any such claim or action.
